Ameca Servicios Corporativos S.L. is the owner of the domain name upvoter.io and of the digital voting platform UpVoter.
This document governs access to and use of the website upvoter.io and the UpVoter digital voting platform (hereinafter, the "Platform"), a web-based SaaS service that allows organisations and users to:
- Create votes, surveys and participatory processes. - Manage participants and access. - Collect and visualise results in real time.
Accessing or using the website or the Platform constitutes full acceptance of these Terms and Conditions.
- Platform: digital voting service accessible online. - Organiser: user who creates and manages a vote. - Participant or voter: person who casts a vote. - Voting process: set of actions aimed at collecting opinions or decisions. - User account: individual access to the system via credentials.
The user agrees to use the website in accordance with applicable law, good faith, public order and these Terms. Use of the website for unlawful purposes or in a way that may harm its operation or the rights of third parties is prohibited.
In particular, the user agrees not to transmit or publish content that:
- Infringes fundamental rights or public freedoms. - Incites or promotes criminal, violent or discriminatory conduct. - Is contrary to the right to honour, personal privacy or one's own image. - Constitutes unlawful, misleading or unfair advertising. - Harms the reputation of UpVoter or third parties.
The Platform is designed for:
- Internal votes within organisations, companies or entities. - Surveys and participatory processes. - Consultations with users, clients or members.
The following are expressly prohibited:
- Using the Platform for illegal or fraudulent purposes. - Manipulating or attempting to alter the voting system. - Interfering with the security of the service. - Sharing access credentials with third parties. - Infringing the rights of third parties through use of the service.
Access to certain features requires prior registration. The user agrees to provide accurate information and to maintain the confidentiality of their credentials. The user shall be responsible for all actions carried out from their account.
The Platform provides exclusively technological infrastructure. The Organiser is solely responsible for:
- The legitimacy of the voting process. - The correct identification and notification of participants. - Compliance with applicable regulations. - The legal validity of the results.
UpVoter assumes no responsibility for decisions made through use of the system.
The Platform implements reasonable security measures to ensure data integrity and protect information. However, the following are not guaranteed:
- Uninterrupted availability of the service. - Complete absence of technical errors. - Immunity against incidents caused by third parties or force majeure.
Interruptions due to maintenance, updates or external causes shall not give rise to liability for UpVoter.
UpVoter may suspend or cancel a user's access in the event of breach of these Terms, fraudulent use or security risks, without prejudice to any legal action that may apply.
UpVoter may modify the Platform's features and these Terms when it deems necessary. Changes will be communicated via the website or through the usual contact channels with the user.
All content on the website and Platform — including software, design, structure, source code, logos, texts and graphic elements — is owned by Ameca Servicios Corporativos S.L. or its licensors, and is protected by intellectual and industrial property law.
Reproduction, distribution, modification, reverse engineering or any other form of unauthorised exploitation is prohibited.
Users may view, print and store website content solely for personal and private use.
The website may contain links to third-party sites. UpVoter does not control and is not responsible for the content, privacy policies or practices of those sites. When leaving upvoter.io, we recommend reading the terms of the site you are accessing.
The processing of personal data is governed by UpVoter's Privacy Policy and the General Data Protection Regulation (GDPR). When the Organiser uses the Platform to manage votes involving third-party data, they act as data controller, with UpVoter acting as data processor under the terms of the corresponding agreement.
UpVoter shall not be liable for:
- Decisions made based on voting results. - Disputes between participants or organisers. - Misuse of the Platform by the user. - Damage arising from service interruptions beyond UpVoter's control.
UpVoter's liability is limited to the correct technical operation of the service.
These Terms shall remain in force for as long as the user maintains an active account or during the provision of the contracted service.
These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts of Donostia-San Sebastián (Basque Country, Spain), or those with competent jurisdiction under applicable law.
